2. Which laws apply to your data
Because we work across the UK and the Channel Islands, more than one data protection law can apply to you, depending on where you are based and where our services to you are delivered:
-
United Kingdom - the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, as amended by the Data (Use and Access) Act 2025.
-
Guernsey (including Alderney and Sark) - the Data Protection (Bailiwick of Guernsey) Law, 2017, regulated by the Office of the Data Protection Authority (ODPA).
-
Jersey - the Data Protection (Jersey) Law 2018, regulated by the Jersey Office of the Information Commissioner (JOIC).
These frameworks are closely aligned (all are modelled on the EU GDPR), so the rights and safeguards described below apply to all our clients regardless of which island or jurisdiction they are in. Where a specific rule differs by jurisdiction, we've noted it.
3. Personal data we collect
-
Name, address, phone number and email address
-
Date of birth (where required for identity verification or tax purposes)
-
National Insurance number (UK), Social Security number (Guernsey/Jersey), or equivalent tax reference number
-
Bank account details, for the purposes of invoicing or processing payments on your behalf
-
Financial records, income and expense information, and other data you provide in connection with our advisory, bookkeeping or tax services
-
Identity verification documents (e.g. passport, proof of address) where required for client due diligence / anti-money-laundering checks
-
Any other personal data you actively provide to us in correspondence or by phone
4. Special category and other sensitive data
Where relevant to your tax or financial affairs, we may process limited special category data (for example, health information relevant to a benefits or insurance claim) or data relating to family members who are fiscally connected to you (such as a spouse or dependants under 18). We only process this data where necessary and with an appropriate lawful basis, such as your explicit consent or a legal obligation.
5. Why we process your data, and our lawful basis
-
To provide our advisory, bookkeeping, tax and compliance services to you (lawful basis: performance of a contract)
-
To meet our legal and regulatory obligations, including tax filing, anti-money-laundering / client due diligence checks, and reporting to HMRC (UK), the Guernsey Revenue Service, or Revenue Jersey (lawful basis: legal obligation)
-
To contact you about changes to our services (lawful basis: legitimate interests, or consent where required)
-
To carry out identity and background checks required under UK and Channel Islands anti-money-laundering regulations (lawful basis: legal obligation)
6. How long we keep your data
We keep personal data only as long as necessary for the purposes it was collected, and to meet our legal retention obligations, which vary slightly by jurisdiction:
-
UK: HMRC generally requires self-employed individuals and businesses to keep tax records for at least 5 years after the 31 January online filing deadline; limited companies must keep records for at least 6 years from the end of the relevant financial year.
-
Guernsey and Jersey: financial and tax records are generally expected to be retained for a minimum of 6 years, in line with local tax and anti-money-laundering record-keeping requirements.
-
Client due diligence / AML records are retained for a minimum of 5 years after the end of our business relationship with you, in line with anti-money-laundering regulations.
Where you ask to handle your own record-keeping obligations to the relevant tax authority, we can discuss transferring your records to you - but you remain responsible for meeting the applicable retention requirement.
7. Sharing your data with third parties
We share personal data with third parties only where necessary to deliver our services or to meet a legal obligation. This includes:
-
HMRC (UK), the Guernsey Revenue Service, and Revenue Jersey, as required to file returns or respond to enquiries on your behalf
-
Regulated processors we use to deliver our services (e.g. accounting software providers, secure file-storage providers), under a data processing agreement that requires them to protect your data to the same standard we do
-
Other third parties, only with your explicit consent
We do not sell your personal data, and we do not transfer it outside the UK, Guernsey or Jersey unless an adequate level of protection is in place (for example, the receiving country has an adequacy decision, or appropriate contractual safeguards such as Standard Contractual Clauses are used).
8. Cookies
Our website uses only technical/functional cookies and privacy-friendly analytics cookies. These help the site run properly and let us understand how it's used, without identifying you personally. You can block or delete cookies at any time through your browser settings; doing so may affect some site functionality.
9. Your rights
Under UK GDPR, the Guernsey DPL 2017 and the Jersey DPL 2018, you have the right to:
-
Access the personal data we hold about you
-
Correct inaccurate or incomplete data
-
Request erasure of your data, where applicable
-
Restrict or object to certain processing
-
Request your data in a portable, machine-readable format
-
Withdraw consent at any time, where processing is based on consent
To exercise any of these rights, contact us at info@mseaccounting.co.uk. To confirm your identity, we may ask for a copy of your photo ID with the photo, MRZ line and ID number redacted. We aim to respond within one month.
10. How to complain
If you're unhappy with how we've handled your data, please contact us first at info@mseaccounting.co.uk so we can try to resolve it directly. As of 19 June 2026, UK data protection law requires us to have a formal internal complaints process: we will acknowledge your complaint within 30 days and respond substantively without undue delay.
If you remain unsatisfied, you can escalate your complaint to the relevant regulator, depending on where you're based:
-
UK: the Information Commissioner's Office (ICO) - ico.org.uk
-
Guernsey: the Office of the Data Protection Authority (ODPA) - odpa.gg
-
Jersey: the Jersey Office of the Information Commissioner (JOIC) - jerseyoic.org
11. How we protect your data
We take appropriate technical and organisational measures to protect your data against misuse, loss, unauthorised access or disclosure. Where possible, we ask that you send sensitive documents through a secure client portal or encrypted channel rather than by ordinary email. If you have concerns about the security of your data, contact us at info@mseaccounting.co.uk.
12. Changes to this policy
We may update this policy from time to time to reflect changes in our services or in the law. The current version will always be available on our website, with the date it was last updated.
